Contents. Introduction.

These terms and conditions apply to all transactions placed online, over the telephone, via e-mail or through the post with David Stagg & Associates Ltd. By placing an order with us you will be deemed to have read, understood and agreed to these terms and conditions. English law governs these terms and conditions and your use of our Web Site and you agree to submit to the non-exclusive jurisdiction of the English court. Nothing in these terms and conditions will be deemed to affect your non-excludable statutory rights.

This Web Site and our terms and conditions have been designed for use within the United Kingdom and under UK law. Whilst we are happy to supply products to outside the United Kingdom, we give no warranty, express or implied, that the use of this Web Site or the placing of any order through this Web Site from outside the UK complies with any applicable non-UK laws or regulations. Accordingly, any products or promotions not permitted under your local law are not offered to you.

All references to the 'company', 'we' or 'David Stagg & Associates Ltd' will refer to David Stagg & Associates Ltd. All references to 'you' or the 'customer' refer to the person or persons purchasing or agreeing to purchase goods or services from the company. References to the Web Site includes all URL's owned by David Stagg & Associates Ltd.

Placing an order & payment.

Orders can be placed online through the Web Site via our secure server, by telephone, post or through our store. Please do not e-mail your credit card details to David Stagg & Associates Ltd, we can not be held responsible for the security of information sent in this way. We accept online payment by VISA or MasterCard.

If you prefer not to order via the Web Site we accept cheques (made payable to David Stagg & Associates Ltd, in pound sterling) through our mail order department. A printable order form is available in either word or in adobe pfd formats. If you require any further information please telephone the mail order department on +44 (0) 1245 478 970.

Credit/debit transactions are subject to validation checks and are authorised by the card issuer, it is essential that you provide us with the cardholder's name exactly as it appears on the card. In order to help reduce instances of credit card fraud, orders without this information will not be processed. David Stagg & Associates Ltd are not liable for late or non-delivery of items if the issuer of your card refuses to authorise the payment.

Prices

Prices and offers available online at David Stagg & Associates Ltd may vary on occasion from those found in retail stores or offered in any mailings. Prices and availability of all goods is subject to change without prior notice. All prices are shown in pound sterling (£) and are exclusive of UK VAT at the current rate.

Products.

We make every effort to ensure that product specifications and descriptions are as accurate as possible, we accept no responsibility for errors or omissions, we reserve the right to alter product specifications without prior notice. David Stagg & Associates Ltd make every effort to ensure that the colours depicted on the Web Site match as closely as possible those of the actual product, obviously due to variations in monitor resolutions and technical limitations some colours may vary.

Ownership of Goods.

All items supplied to you remain the property of David Stagg & Associates Ltd until final payment of all sums owing in respect of those goods has been received in full by us.

A Contract between the customer and David Stagg & Associates Ltd for the sale of our products will only exist once an order has been accepted, processed and dispatched (at which point the buyers credit/debit card will be charged for the value of the goods dispatched, plus postage), and the goods have been adopted. This does not affect the customer's statutory rights.

Exchanges & Returns.

David Stagg & Associates Ltd hope you will be satisfied with your purchases, if we dispatch the wrong item or you find that the goods are faulty, you can return them for a full refund (including any delivery charges, at our current rates) within 14 days after the receipt of the goods. In the unlikely event of this happening, simply return the goods along with a copy of the original receipt and the delivery note to the address below.

In the case of faulty item returns, Health and Safety regulations dictate that the goods must be clean and free from mud and dirt, otherwise the items can not be processed.

If we have dispatched the goods as ordered but you do not want them, they may be returned for a full refund within 7 days after the receipt of the goods. In this case any delivery charges incurred are non-refundable, only the cost of the goods will be refunded.

If the items have been dispatched as per your order, but are unwanted due to their description on our Web Site being misleading or incorrect, you may return them for a refund (including delivery charge, at our current rates) within 14 days after the receipt of the goods.

Any items returned for refund or exchange must be unused, still have their original labeling and packaging, and be accompaniedby a copy of the original receipt and the delivery note. Nothing in these conditions affects your statutory rights as a consumer. The card used to make the purchase will be credited with the original purchase amount (less any delivery charges paid where appropriate.)

David Stagg & Associates Ltd aim to meet The Distance Selling Regulations and subject to the provisions of our returns policy outlined above, every customer has the right to cancel their order within 7 working days of receiving the goods. Goods must be unused and be returned along with their original packaging and labeling. This does not apply to any items personalised or made to your specifications.

When returning goods to David Stagg & Associates Ltd we recommend that they are sent using recorded delivery with insurance paid as a minimum.

Guarantee.

All products are guaranteed against failure to provide reasonable wear owing to defective workmanship or materials. The length of the guarantee is detailed on the individual product page and is valid from the date of the original invoice (unless otherwise stated) and excludes faults caused by accident, neglect or misuse. Should you need to make a claim please return the item with a copy of the original receipt to our returns department at:

Please identify clearly the area or part that has failed.To comply with health and safety regulations ensure items are in a clean, dry condition, otherwise they may be returned to you without our attention.

Out Of Stock.

We aim to keep the Web Site as up to date as possible, If any item you have chosen is unavailable you will be contacted via your e-mail address or by telephone as soon as possible. We may be able to offer you an alternate colour, product or you may cancel part or all of your order.

David Stagg & Associates Ltd aim to deal with all complaints as efficiently and effectively as possible. In the first instance, your complaint should be emailed to service@davidstagg.co.uk. Alternatively you may write to the Customer Service Department at David Stagg & Associates Ltd, Electron House, West Hanningfield Road, Great Baddow, Chelmsford, Essex, CM2 8JT. If you prefer you may call our customer service team on +44 (0) 1245 478 970 between the hours of 10am - 4pm, Monday to Friday. If we are unable to take your call an answering service is available. Calls to this number are charged at the national rate.

We will endeavor to acknowledge and deal with any emailed, mailed or telephoned complaint within 5 working days of receipt. If we are unable to deal with your enquiry within this period we will advise you of a likely timescale and keep you informed of any information as soon as possible.
